1. These terms
TalkNTalk is operated by Techspace Softwares Limited, a company in Kenya (“TalkNTalk”, “we”, “us”). These terms form an agreement between us and the person or organisation that creates an account (“you”).
By creating an account, buying credits or a plan, or using our API, you accept these terms. If you accept them for an organisation, you confirm that you are allowed to bind it.
2. Our services
TalkNTalk lets organisations send and manage messages, including:
- bulk and individual SMS, under a sender ID or a default sender;
- sender ID applications to mobile networks;
- WhatsApp messaging from numbers you link to your account, including a shared inbox, group messaging and scheduled messages;
- an API and webhooks to use these features from your own systems.
We may add, change or retire features. We will give reasonable notice before removing a feature you pay for.
3. Your account
- You must be at least 18 and give accurate, current details about yourself and your organisation.
- Keep your password and API keys secret. Anything done with your login or keys is treated as done by you.
- You are responsible for the people you invite to your organisation and the roles you give them.
- Tell us straight away at info@talkntalk.africa if you think your account or a key has been misused.
4. Acceptable use
You may only message people who have agreed to hear from you or who have an existing relationship with your organisation, and you must stop messaging anyone who asks you to. You must comply with the Kenya Information and Communications Act and the regulations made under it, the Data Protection Act, 2019, and any other law that applies to your messages.
You must not use TalkNTalk to send or support:
- unsolicited bulk messages (spam), or messages to purchased or scraped number lists;
- fraud, phishing, scams or messages that pretend to be another person or organisation;
- content that is illegal, threatening, hateful, sexually explicit or that harasses anyone;
- links to malware or attempts to break, overload or probe our systems;
- reselling access without our written agreement.
We may hold, block or refuse messages and suspend accounts that appear to break these rules, and we may have to share information with mobile networks or authorities when the law requires it.
5. Sender IDs
- Sender ID registration costs KES 6,500 per network, payable when you apply.
- You must have the right to use the name you apply for. Approval is decided by each network, not by us, and a network may reject, suspend or withdraw a sender ID.
- Until a sender ID is approved, messages are sent under a default sender.
6. WhatsApp on linked numbers
Our WhatsApp features work by linking your existing WhatsApp number to TalkNTalk, in the same way WhatsApp’s linked devices work. This is notMeta’s official WhatsApp Business API, and TalkNTalk is not affiliated with, endorsed by or sponsored by WhatsApp or Meta.
- You remain responsible for your WhatsApp account and for following WhatsApp’s own terms and policies.
- WhatsApp may limit, restrict or ban numbers at its discretion, especially numbers that send unsolicited or high volumes of messages. We cannot prevent or reverse this.
- Plan fees cover access to TalkNTalk for the period paid and are not refunded if WhatsApp restricts a number.
7. Prices, credits and payment
- Prices are in Kenyan shillings and are shown on our pricing page and in your dashboard before you pay.
- SMS is prepaid. One credit sends one SMS part of up to 160 characters. Longer messages use one credit per part. Bonus credits work like paid credits.
- WhatsApp plans cover a set number of linked numbers for the month or year paid for. They end at the end of that period unless you renew.
- We may change prices. Changes apply to purchases made after the change, not to credits or plans you have already paid for.
Payments are not refundable except where the law requires a refund or where we have not provided a service you paid for.
8. Message delivery
We pass your messages to mobile networks and to WhatsApp, which deliver them to handsets. Delivery depends on the recipient’s phone, network coverage and those third parties, so we cannot guarantee that every message is delivered or delivered at a particular time. Delivery statuses reflect the information those parties report to us.
9. API and webhooks
- Use the API as described in our developer documentation.
- We may apply rate limits or pause traffic that threatens the stability of the service.
- Your webhook endpoints should accept deliveries promptly. Failed deliveries are retried for a limited time, after which they can be resent from your dashboard.
10. Your content and data
You own your contact lists, message content and other data you put into TalkNTalk. You give us permission to use it only as needed to run the service for you.
For personal data about the people you message, you are the data controller and we process it on your behalf, as described in our privacy policy. You must have a lawful basis under the Data Protection Act, 2019 for every contact you upload.
11. Suspension and closing your account
You can stop using TalkNTalk at any time and ask us to close your account.
We may suspend or close an account that breaks these terms, puts other customers or the networks at risk, or where the law requires it. Where it is reasonable, we will tell you why and give you a chance to fix the problem first.
12. Liability
The service is provided with reasonable care and skill, but we do not promise that it will be uninterrupted or error-free. Nothing in these terms limits liability that cannot be limited under Kenyan law.
Otherwise, we are not liable for indirect or consequential losses, such as lost profits or business, and our total liability to you in any 12-month period is limited to the amount you paid us in that period.
13. Changes to these terms
We may update these terms. If a change materially affects you, we will tell you by email or in your dashboard before it takes effect. Continuing to use TalkNTalk after that means you accept the updated terms.
14. Governing law
These terms are governed by the laws of Kenya. We will try to resolve any dispute with you informally first. If we cannot, the courts of Kenya will have jurisdiction.
