What personal data TalkNTalk handles, why, who sees it and the rights you have over it under Kenya’s Data Protection Act, 2019.

1. Who we are

TalkNTalk is operated by Techspace Softwares Limited in Kenya. We handle personal data in line with the Data Protection Act, 2019 and the regulations made under it.

  • We are the data controller for information about our customers and their team members, and about visitors to this website.
  • We are a data processor for the contact lists and message content our customers upload. For those, the customer that sent the message decides how the data is used.

2. What we collect

  • Account details: your name, email, phone number, organisation and the colleagues you invite.
  • Billing records: what you bought, when and how much. Payments are handled by our payment providers; we do not store full card or mobile-money PINs.
  • Customer data you upload: contact lists, groups, templates, message content and delivery statuses.
  • WhatsApp data: for numbers you link, the chats, contacts and groups needed to send messages and show your shared inbox.
  • Technical data: log records, IP addresses, browser and device information, and API and webhook activity.
  • What you tell us: messages you send to us by email or through our contact page.

3. How we use it

  • to run your account and deliver your messages, delivery reports and webhooks;
  • to process payments, issue invoices and keep accounting records;
  • to answer support requests and tell you about changes to the service;
  • to keep the service secure and to detect spam, fraud and misuse;
  • to meet our legal obligations, including requests from regulators;
  • to send you product news, only where you have agreed or where the law allows. You can opt out at any time.

5. Who we share it with

We do not sell personal data. We share it only with:

  • mobile network operators and messaging partners, so your messages can be delivered;
  • payment providers, to take and confirm payments;
  • hosting and infrastructure providers that store and run the service for us;
  • professional advisers such as auditors and lawyers;
  • authorities, where the law requires us to.

Everyone we share data with must protect it and use it only for the purpose we gave it to them for.

6. Transfers outside Kenya

Some of our service providers may store or process data outside Kenya. When that happens, we make sure there are appropriate safeguards in place, as the Data Protection Act, 2019 requires.

7. How long we keep it

We keep account information while your account is open. Message content, contact lists and delivery records are kept for as long as you need them to run campaigns and reports. Billing records are kept for as long as tax and accounting law requires. When data is no longer needed, we delete it or make it anonymous.

8. How we protect it

We use encrypted connections, access controls, separate API keys for each integration and role-based access for team members. No system is perfectly secure, so if we become aware of a breach that affects your data, we will notify you and the Data Protection Commissioner as the law requires.

9. Your rights

Under the Data Protection Act, 2019 you have the right to:

  • be told how your personal data is used;
  • access the personal data we hold about you;
  • object to processing, including for direct marketing;
  • have inaccurate data corrected, and data you no longer want us to hold deleted;
  • receive your data in a portable format.

Email info@talkntalk.africa to use any of these rights. If you are unhappy with how we handle your data, you can complain to the Office of the Data Protection Commissioner (ODPC).

10. If you received a message from one of our customers

Organisations use TalkNTalk to send their own messages, so the sender decides who they contact. To stop their messages or ask what data they hold about you, contact that organisation first. If you cannot reach them, email us with the sender name and the date of the message, and we will help.

11. Cookies

This website does not use advertising cookies. The TalkNTalk dashboard uses cookies that are essential to keep you signed in and to keep your session secure.

12. Children

TalkNTalk is a service for organisations and is not meant for anyone under 18.

13. Changes to this policy

We may update this policy. The date at the top shows when it last changed, and we will tell you about important changes by email or in your dashboard. See also our terms of service.
